Section 1 – Introduction

This website, ISH Cosmetics (“the Site”), is operated by ISH Cosmetics. By accessing or using the Site and our services, you agree to be bound by these Terms & Conditions, as well as any additional policies referenced herein or published on the Site.

These Terms apply to all users of the Site, including visitors, customers, vendors, merchants, and contributors of content.

Section 2 – Orders & Payment

All orders placed through the Site are subject to acceptance and availability.

We accept payments via major credit and debit cards (Visa, Mastercard, American Express), PayPal, and other payment methods offered through our payment provider (e.g. Shopify Payments).

All prices are listed in euros (€) and include or exclude VAT where applicable, depending on your location and legal requirements.

ISH Cosmetics reserves the right to refuse or cancel any order at its sole discretion, including but not limited to cases of suspected fraud, misuse of the Site, or violation of these Terms.

Section 3 – Product Information

We aim to ensure that all product descriptions, ingredients, pricing, and availability information on the Site are accurate and up to date.

However, we do not guarantee that all information is always complete, current, or error-free. Product information is provided for general informational purposes and should not be the sole basis for purchasing decisions.

Section 4 – Prices & Modifications

All prices are subject to change without prior notice.

ISH Cosmetics reserves the right to modify or discontinue products, pricing, or services at any time without liability to customers or third parties.

Section 5 – User Content & Submissions

If you submit ideas, feedback, reviews, or other content (“User Content”), whether requested or unsolicited, you grant ISH Cosmetics a non-exclusive, worldwide, royalty-free right to use, reproduce, publish, and distribute such content for marketing or operational purposes.

We are not obligated to:

  • Keep submissions confidential
  • Provide compensation
  • Respond to submissions

We reserve the right to remove content that is unlawful, offensive, misleading, or violates these Terms.

Section 6 – Shipping & Delivery

We ship internationally where available.

Shipping costs and estimated delivery times are shown at checkout and may vary depending on destination and shipping method.

Delivery times are estimates only and are not guaranteed.

ISH Cosmetics is not responsible for delays caused by courier services, customs processing, or incorrect delivery information provided by the customer.

Once an order has been handed over to the courier, responsibility transfers to the shipping provider.

Section 7 – Returns & Right of Withdrawal

Customers within the European Union have the legal right to withdraw from their purchase within 14 days of receiving their order, without providing a reason.

However, due to hygiene and safety regulations, certain skincare products may not be eligible for return if:

  • The seal has been broken
  • The product has been opened or used after delivery

To be eligible for a return:

  • Items must be unused, unopened, and in original condition
  • Original packaging must be intact
  • Hygiene seals must remain unbroken (if applicable)

Return shipping costs are the responsibility of the customer unless the item is defective or incorrect.

Section 8 – Refunds

Once your return is received and inspected, we will notify you of the approval or rejection of your refund.

If approved:

  • Refunds will be processed within 14 business days
  • Refunds will be issued to the original payment method
  • Original shipping costs are non-refundable

If a return does not meet our conditions, we reserve the right to refuse the refund and return the item to the customer.

Section 9 – Damaged or Incorrect Items

If you receive a damaged, defective, or incorrect item, please contact us within 7 days of delivery at info@ishcosmetics.com.

Please include:

  • Order number
  • Photos of the issue
  • A short description

We will assess the situation and offer an appropriate solution, which may include a replacement or refund.

Section 10 – Limitation of Liability

ISH Cosmetics does not guarantee that the Site or services will always be uninterrupted, secure, or error-free.

All products and services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, ISH Cosmetics shall not be liable for any indirect, incidental, or consequential damages arising from the use of our Site, products, or services.

Section 11 – Indemnification

You agree to indemnify and hold harmless ISH Cosmetics, its directors, employees, partners, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the Site or violation of these Terms.

Section 12 – Prohibited Uses

You agree not to use the Site for:

  • Any unlawful activity
  • Violation of applicable laws or regulations
  • Infringement of intellectual property rights
  • Harassment, discrimination, or abuse
  • Uploading malicious software or harmful content

  • Misleading or fraudulent behavior

We reserve the right to terminate access if these rules are violated.

Section 13 – Errors & Inaccuracies

Occasionally, information on the Site may contain errors, inaccuracies, or omissions relating to product descriptions, pricing, or availability.

We reserve the right to correct any errors and update information at any time, including after an order has been placed.

Section 14 – Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain valid and enforceable.

Section 15 – Termination

These Terms remain in effect unless terminated by either party.

ISH Cosmetics reserves the right to suspend or terminate access to the Site if we believe a user has violated these Terms.

Section 16 – Entire Agreement

These Terms, along with any policies posted on the Site, constitute the full agreement between you and ISH Cosmetics.

Failure to enforce any right or provision does not constitute a waiver of that right.

Section 17 – Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

Section 18 – Changes to Terms

ISH Cosmetics reserves the right to update or modify these Terms at any time.

It is your responsibility to review them periodically. Continued use of the Site constitutes acceptance of any changes.

Section 19 – Discount Codes & Promotions

Discount codes cannot be applied to already discounted products during sale periods.

Discounts cannot be combined unless explicitly stated.

If a technical error results in incorrect pricing, we reserve the right to adjust or cancel the order.

By using a discount code or participating in a promotion, you agree to these terms.
